Trooper depositions postponed in alleged beating of lawyer
CHARLESTON, W.Va. -- Three state troopers will not have to give depositions under oath until a federal grand jury has completed its investigation into the alleged beating of a Charleston lawyer while in police custody, a federal magistrate ruled Friday.
Roger A. Wolfe sued four troopers after he was hospitalized following his arrest on DUI charges in June 2007. Wolfe alleged that Paul A. Green and Jason S. Crane beat him so severely after he had a run-in with Kristy L. Layne while handcuffed at the South Charleston barracks that spinal fluid came out of his nose.
Wolfe also sued emergency-room doctor Jason A. Tackett, alleging he allowed State Police Sgt. John K. Rapp to interrogate Wolfe for an hour before Tackett treated him.
In March, Layne, Crane and Rapp asked a judge to postpone their depositions in Wolfe's civil lawsuit because they had been subpoenaed by a federal grand jury looking into the matter.

Then if they ever or after they give depositions under oath to a Federal Grand Jury ......... they will claim they are not allowed to "talk about it" until the Federal investigation is complete and said Federal action is resolved/terminated.
