There may be a snag in the Kanawha-Charleston Health Department's plan to move across town.
A clause in a 1975 contract used to secure federal funding to build the Health Department requires that the site's use remain "undisturbed for a period of not less than 50 years" - or until 2025.
On Thursday, health board members voted unanimously to ask the Kanawha County Commission to review the decades-old stipulation.
County and city officials want the health agency to move from its present site across from the Charleston Civic Center to make way for a new downtown hotel.
"If it turns out this property is forfeited to the federal government or can't be sold, we're all going to look foolish," said health board member Stephen Weber, a Charleston lawyer who reviewed the document this week. "It's the county's property. They are the ones who need to investigate this."
A previous clause in the county's 1975 agreement with the federal government states that the property was required to remain as a health department until 1995, which it has.
But health board members aren't sure how to interpret the requirement that the site stay undisturbed for 50 years.
"It's clearly a question that needs to be raised," Weber said. "We need to find out if this is an issue, and if not, then fine."
The health board has tentatively approved a plan to move the agency's Lee Street headquarters to the city-owned Morris Square warehouse beside Appalachian Power Park.

Also Thursday, board members:
  • Postponed hiring an interim health director to replace outgoing Executive Director Dr. Kerry Gateley, who's leaving July 9 to take a similar job in Lynchburg, Va. About a dozen doctors have applied for the interim post.

    A three-member committee plans to hire an acting health director by the end of next week, and then submit the candidate for final approval July 17.
    "We have to have someone in place before Dr. Gateley leaves," said Brenda Isaac, a health board member who also works as lead nurse for Kanawha County schools. "We're getting more applicants than we thought we would get."

  • Health officials have rescinded plans to charge Sternwheel Regatta festival and Taste of Charleston vendors a $25 inspection fee. The department has waived the fee for nearly 30 years.

    The department considered reinstating the charge after Charleston Mayor Danny Jones persuaded City Council to withhold $100,000 from the health agency's budget earlier this year.
    The agency withdrew its plan to charge the fee this week.

    If they had just had Bob Byrd to put a little earmark in some bill it would never have been restricted like that. bounce

    How would an earmark have changed the agreement that financed the health department in 1975?

    Well, I suppose what Sherm is thinking goes something like this:

    Big Daddy gets an earmark to just fund the Health Department. No financing required, it's just straight out government pork courtesy of the illustrious Senator Byrd. So there is no requirement about how long the building must be occupied by the Health Department, not that there would be any chance of Dollar Bill Danny or any other dictatorial politician would ever try to force them out to tear down the "Senator Robert Byrd Health Department Building." At least not until after the Senator has been dearly departed long enough to be canonized, that is.

    Speaking of Dollar bill Danny, he actually charged to park at the municipal auditorium for Poca's graduation, even though the school rented the auditorium for the graduation. When Casci found out, they opened their lot for free but the city of Charleston charged $3.00 per car to park.

    If I lived in Charleston, I would move out. I haven't been back since graduation day and I won't go back, at least not to spend my money.

    He is a piece of work. I think we should fire off emails to the Board of Ed demanding that future graduations be held anywhere other than Charleston.

    We would never go to the city if not for the Clay Center. My son loves it there and our friend owns a restaurant/bar next door. We go to the Clay and we visit Kay & her boys and grab a bite to eat.

    I have no one graduating next year, but year after next, I'm pushing for the auditorium in Nitro. Either that or outside. If they go back to the Municipal Auditorium, it will mark the next time I actually stop in Charleston for anything other then a red light as long as sister Danny is Mayor.

    Well I think you should push for it this year. We all should. Our tax dollars are spent for these events whether we have children participating or not.

    Did anyone else have a graduation on a weekday evening?

    I know the high school to which I am usually associated (Hoover) switched to a wednesday evening this year - MUCH to the dismay of the parents who were used to bringing in out of town family on weekends when the graduation had been on friday evening.

    The faculty and principal petitioned the BOE to allow for a rotating schedule of assigned evenings for graduation when using the Municipal Auditorium and they were granted it for this year. I don't know if it'll continue for next year or not.

    I was just wondering when other schools' had their graduation about the Valley. Hubby and I graduated from Wood County schools and it wasn't a big deal what night graduation was on.

    Poca graduated on a Sunday and cheap a$$ Danny Jones charged us $3.00 to park, the cheap ba$tard.
